Xiaomi's unannounced Mi 5 and Mi 5 Plus smartphone alongside other company's mobile devices have been alleged to infringe US patents.

A company named Blue Spike has put up a patent infringement lawsuit against the Chinese company and has claimed for infringement arising under the "patent laws of the United States".

Blue Spike has accused the majority of Xiaomi products to infringe its patents including the Mi 4, Mi 4 LTE, Mi 4c, Mi 4i, Mi Note Plus, Mi Note Pro, Redmi 1S, Redmi 2, Redmi 2 Prime, Redmi 2 Pro, Redmi 2A, and Redmi Note 2.

In its lawsuit, the company writes, "Defendant designs, develops, employs, and/or manufactures Address Space Layout Randomization ("ASLR") software, systems, and/or technology. Defendant makes, uses, offers for sale and/or imports into the US products, systems, and/or services including, but not limited to, its Mi 4, Mi 4 LTE, Mi 4c, Mi 4i, Mi 5, Mi 5 Plus, Mi Note Plus, Mi Note Pro, Redmi 1S, Redmi 2, Redmi 2 Prime, Redmi 2 Pro, Redmi 2A, and Redmi Note 2 devices (collectively, "Accused Products"), which infringe one or more claims of the Patent-in-Suit."

The company has also claimed (via TimesNews) that the defendant (Xiaomi) has not sought or obtained a license for any of Blue Spike's patented technologies.

Blue Spike on its official website notes that it owns over 98 patents in forensic watermarking, signal abstracting, data security, software watermarks, product license keys, ASLR, deep packet inspection, and license code from authorised software to bandwidth securitisation.

It's worth noting that Xiaomi is not the first brand being targeted by Blue Spike as the company has previously targeted big tech companies including the likes of Google, Yahoo, and Adobe among others.
